Divided performance of patented methods in Australia: a call to codify procured infringement
United States decision - if and how a patentee may enforce a method claim against a competitor where that competitor performs some processes, but leaves other processed to a third party to perform - 'divided performance' - lack of Australian patent infringement to address divided performance - use of the common law mechanism of procured procurement - call for the codification of procured infringement in the Patents Act 1990 (Cth) in order to address ambiguities and uncertainty.
