<p>Objective: to analyze the existing legal regulation in Spain regarding the decision-making capacity of underage adolescents in relation to abortion. Methods: comparison of the legislation in force in Spain in recent decades, the relevant legal literature on the subject and the positions of international organizations. Results: the high ideological component of this problem can be very easily demonstrated. The legislation has undergone numerous reforms over the years, granting more or less autonomy to underage women, depending on the political ideology of the ruling party. Conclusion: this is a very important issue that is unfortunately highly ideologized. Given the various conflicting interests, it seems that respect for women's sexual and reproductive rights should take precedence, even if they are minors, provided they have sufficient judgment. There are several reasons for granting minors the full capacity to decide freely on abortion without the need for the consent of their legal representatives, as relevant international organizations have stated.</p>
