This report reviews Tasmania's guardianship laws for people with a disability and recommends a major overhaul to the legislation. This report has been published by the Tasmania Law Reform Institute at the University of Tasmania. The report presents findings of a review of the Guardianship and Administration Act 1995 (Tas) commissioned by the Attorney-General of Tasmania. The aim of the review was to investigate whether the legislation promotes and protects the rights of people with impaired-decision making capacity and upholds the United Nations Convention on the Rights of Persons with a Disability. Among its findings, the review found that the guardianship laws are outdated and recommends significant changes to instil the principles and obligations of the Convention.
